Can I work while waiting for my application for a temporary residence permit to be processed on the basis of the stamp in my passport confirming that I have submitted the application?

Simply having a stamp in your passport does not mean that you can ‘automatically’ start working in Poland.

In order for you to work legally, one of the following circumstances must apply:

  1. on the date of submitting the application for a temporary residence permit, you had the right to work in Poland (e.g. a statement on entrusting work to a foreigner from the Labour Office or a work permit) and you currently have such a right;
  2. you have submitted another application for a single residence and work permit in the same company and for the same position, the same type of contract (continuation of employment);
  3. on the date of submitting the application for a single residence and work permit, you had a valid type A work permit and you submitted an application for the same company and the same position, the same type of contract (continuation of employment) for which you had a type A work permit;
  4. on the date of submitting the application for a single residence and work permit, you had a valid declaration of entrusting work to a foreigner from the Labour Office issued on the basis of an employment contract, under which you had worked continuously for more than 3 months, and you submitted an application for the same company and the same position and the same type of contract (continuation of employment) for which you had a statement issued;
  5. on the date of submitting the application for a single residence and work permit, you had a valid declaration of entrusting work to a foreigner from the Labour Office issued on the basis of an employment contract, under which you had worked for less than 3 months, the application did not contain any formal deficiencies and you received a stamp – you are awaiting a decision on your residence – you can only work until the end of the declaration, unless your employer additionally submits an application for a type A work permit after you have worked for a full 3 months under the declaration, but before its expiry, and the type A work permit will be submitted for the same company, position and type of contract for which the declaration was issued by the Labour Office;
  6. you are in a different situation that exempts you from obtaining a work permit, e.g. you are a graduate of a Polish secondary school, full-time higher education or full-time doctoral studies at a Polish university.

If you are staying in Poland on the basis of a single temporary residence and work permit issued on the basis of employment with an employer with whom you no longer work, you should report this information in writing to the office.

As a rule, however, if your decision specifies an employer and specific terms of employment, the permit you hold only allows you to work for that specific employer and under the terms specified in the decision. Therefore, if you have changed employers, you should apply for a change to your temporary residence and work permit.

You do not meet the basic condition of 5 years of residence in Poland, because residence related to studies is only counted as half. Therefore, if you submit an application, we will refuse to grant you a long-term resident’s residence permit.

The period of stay in Poland includes:

  • the entire period of stay under visa-free travel
  • the entire period of stay on the basis of a visa (with certain exceptions)
  • the entire period of stay in Poland on the basis of a temporary residence and work permit
  • the entire period of stay on the basis of an EU Blue Card issued both in Poland and in another EU Member State
  • the entire period of stay in Poland during proceedings for international protection if it exceeds 18 months
  • half of the period of stay in Poland in the case of a stay issued on the basis of a student visa, a temporary residence permit for studies or vocational training.

No. A stable and regular source of income is one that recurs at regular intervals, such as a salary.
